Desugarly Privacy Policy

This Privacy Policy describes how (“Company,” “we,” “us,” or “our”) collects, uses, and shares your Personal Information and Sensitive Personal Information when you use our Desugarly mobile application and related services (the “Service”). We are committed to protecting your privacy and handling your data with care, in compliance with applicable data privacy laws in the United States, including the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA/CPRA”).
1. Information We Collect
We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.
a. Personal Information (PI) This includes information that can identify you directly or indirectly. The categories of Personal Information we collect depend on how you use our Service and include:
Identifiers: Your name, email address, and IP address.
Internet or Other Electronic Network Activity Information: Your browsing history, device information (such as OS and device model), and app error logs.
Inferences: We may draw inferences from other Personal Information we collect to create a profile about you reflecting your preferences and characteristics.
b. Sensitive Personal Information (SPI) The CCPA/CPRA defines certain types of data as Sensitive Personal Information, which requires a higher level of protection. The core function of the Desugarly Service involves the collection of your health data, which is considered a category of Sensitive Personal Information under US privacy laws.
We collect the following categories of Sensitive Personal Information with your explicit consent:
Health Information: Data concerning your physical health condition or diagnoses, including blood sugar levels (e.g., average fasting/post-meal blood glucose), diabetes type, and whether you take medication.
Biometric Information: We may process your biometric data (e.g., from food images you upload) to analyze and predict blood glucose spikes.
Other Health-Related Data: Information you provide in your profile, such as your height, weight, gender, age, exercise level, stress level, and sleep quality.
Geolocation: If you enable this feature, we may collect precise geolocation data to provide location-based services, which is also considered SPI.
2. How We Use Your Information
We use the information we collect for business purposes that are reasonably necessary and compatible with the context in which the information was provided. This includes:
To Provide the Service: To create a personalized blood glucose prediction model and provide tailored health management advice based on your food photos and health data.
To Manage Your Account: To identify and authenticate you, manage your membership, and prevent fraudulent use of the Service.
To Improve the Service: To analyze Service usage, collect crash logs, and improve the quality and stability of the app. We may use anonymized or de-identified data for research and development purposes.
To Communicate with You: To respond to your inquiries, provide customer support, and address any issues you may report.
To Ensure Security: To detect and investigate security incidents and protect against malicious, deceptive, or illegal activity.
3. How We Share Your Information
We do not sell or share your Personal Information or Sensitive Personal Information for cross-context behavioral advertising (i.e., targeted advertising). We may disclose your information to third parties only for the following business purposes:
Service Providers and Contractors: We use third-party service providers to help us operate our Service. These providers are contractually obligated to use your Personal Information only for the purpose of providing services to us and are prohibited from selling or sharing it for their own purposes.
Supabase, Inc. (USA): Cloud server operation, data storage, and management.
OpenAI, L.L.C. (USA): Analysis of food images and health data to predict blood glucose spikes.
Functional Software, Inc. (Sentry) / Firebase Crashlytics (USA): App error log collection and analysis.
Legal Compliance: We may disclose information if required by law, subpoena, or government investigation.
4. Your Privacy Rights
Under US privacy laws, particularly the CCPA/CPRA, you have specific rights regarding your Personal Information and Sensitive Personal Information. These rights include:
Right to Know: You have the right to request that we disclose to you the categories of Personal Information we have collected, the purposes for which we use it, and the categories of third parties to whom the information is shared. You also have the right to request a copy of the specific pieces of Personal Information we have collected about you.
Right to Delete: You have the right to request that we delete the Personal Information we have collected from you, subject to certain exceptions. We will also direct our service providers to delete your information.
Right to Correct: You have the right to request that we correct any inaccurate Personal Information that we maintain about you.
Right to Limit the Use of Sensitive Personal Information: You have the right to direct us to limit the use and disclosure of your Sensitive Personal Information to only those purposes necessary to provide the Service.
Right to Opt-Out of Sale/Sharing: Although we do not sell or share your data for targeted advertising, you have the right to opt-out of such activities. We will provide a clear and conspicuous link on our website titled “Do Not Sell or Share My Personal Information” or “Your Privacy Choices”.
Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

6. Children's Privacy
Our Service is not directed at and is not intended for use by children under the age of 13. We do not knowingly collect Personal Information from children under 13. If we learn that we have collected information from a child under 13, we will take steps to promptly delete the information.
7. International Data Transfers
Our Service is operated from South Korea, but your Personal Information and Sensitive Personal Information may be stored and processed on servers located in the United States or other countries where our service providers operate. By using our Service, you consent to the transfer of your information to these locations. We ensure that any such data transfers comply with applicable legal requirements.

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify you by posting the updated policy in the app or on our website.
